Smart Nap

These Terms of Use ("Terms") govern your access to and use of the Smart Nap (the "App") mobile application for iPhone and Apple Watch and any related services provided by BEAST LABS, SLU ("Beast Labs", "we", "us", "our").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Scope
These Terms apply only to the Smart Nap App (including the Apple Watch companion app). Any terms for the beast-labs.com website (if applicable) are separate.
3. Eligibility
You must be at least 13 years old to use the App. If you are under the age of legal majority in your jurisdiction, you may use the App only with the permission of a parent or legal guardian.
4. Apple EULA and App Store Terms
Your use of the App is also subject to Apple's Licensed Application End User License Agreement ("Standard Apple EULA") unless we provide a separate EULA. In the event of a conflict between the Standard Apple EULA and these Terms, these Terms govern to the extent permitted by law.

You acknowledge that these Terms are between you and Beast Labs only, and not with Apple. Beast Labs, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support services for the App.
5. App Purpose and Health Disclaimer
Smart Nap helps you track and optimize nap sessions by detecting sleep onset via Apple Watch sensors and HealthKit data, managing alarms, and providing sleep efficiency metrics.
Smart Nap is NOT a medical device. The App is provided for informational and wellness purposes only. It does not diagnose, treat, cure, or prevent any disease, medical condition, or sleep disorder. The sleep data, efficiency metrics, and recommendations provided by Smart Nap are for general informational purposes only.
Always consult a qualified healthcare professional if you have concerns about sleep disorders, chronic fatigue, or any health condition. Do not rely on Smart Nap as a substitute for professional medical advice, diagnosis, or treatment.
Smart Nap is not intended to replace medical-grade sleep monitoring equipment or clinical sleep studies.
6. License and Usage Rights
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and applicable law.
You agree not to:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or attempt to extract source code except where permitted by applicable law
- Use the App to violate any law or infringe on the rights of others
- Interfere with or disrupt the App's security or performance
- Redistribute, sublicense, or commercially exploit the App
- Use the App in any manner that could damage, disable, overburden, or impair any Beast Labs service
7. Accounts
Smart Nap does not require you to create an account. The App functions without user registration. Your subscription status is managed anonymously through Apple's In-App Purchase system and RevenueCat.
You are responsible for maintaining the security of your device and Apple ID.
8. Smart Nap Pro — Subscriptions and In-App Purchases
8.1 Subscription Plans
Smart Nap offers only the following auto-renewable subscription plans to unlock Pro features ("Smart Nap Pro"):
- Weekly — auto-renewable subscription billed every 7 days
- Yearly — auto-renewable subscription billed every 12 months
Smart Nap does not offer Monthly or Lifetime plans.
Prices are displayed in the App and in the App Store before purchase, and may vary by region and currency as determined by Apple. Prices include applicable taxes where required.
8.2 Free Trial
Smart Nap Pro may offer a 3-day free trial. The free trial period is clearly displayed before purchase. If you do not cancel before the end of the 3-day trial period, your subscription will automatically convert to a paid subscription and your Apple ID will be charged the subscription price.
Any unused portion of a free trial period will be forfeited when you purchase a subscription. Free trials are available only to new subscribers. If you have previously subscribed to Smart Nap Pro, you may not be eligible for a free trial. Eligibility for and duration of free trials is determined by Apple and may vary.
8.3 EU/EEA Right of Withdrawal (Cooling-Off Period)
If you are a consumer in the European Economic Area (EEA) or the United Kingdom, you have a legal right to withdraw from a digital content purchase within 14 days of the transaction (the "cooling-off period"), subject to the following:
- By purchasing a subscription and consenting to immediate access, you acknowledge that you may lose your right of withdrawal once the digital service has been fully provided during the cooling-off period.
- For free trials, the cooling-off period begins when the paid subscription commences (i.e., after the free trial converts to a paid subscription).
- Beast Labs does not process payments or refunds directly. All subscription payments and refunds are handled exclusively by Apple through the App Store. To exercise your right of withdrawal, request a refund directly through Apple.
This right is provided in accordance with EU Directive 2011/83/EU on Consumer Rights. Refund eligibility and processing are subject to Apple's refund policies. Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws in your jurisdiction.
8.4 Billing and Payment
- Payment will be charged to your Apple ID account at confirmation of purchase.
- For auto-renewable subscriptions, your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current billing period, at the same price as the current subscription period.
- If the subscription price changes, you will be notified in advance, and the new price will apply from the next billing period. You may cancel before the new price takes effect.
8.5 How to Cancel
You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then. To cancel:
- Open Settings on your iPhone
- Tap your name (Apple ID) at the top
- Tap Subscriptions
- Select Smart Nap
- Tap Cancel Subscription
Alternatively, you can manage subscriptions through the App Store app. Simply deleting the App does not cancel your subscription.
8.6 Restore Purchases
If you change devices or reinstall the App, you can restore your purchase using the App's "Restore Purchases" feature or through the subscription management screen.
8.7 RevenueCat and Superwall
We use RevenueCat to validate your purchase status and manage entitlements across devices. RevenueCat processes limited purchase-related and technical information as described in our Privacy Policy.
We use Superwall to present and configure paywall screens within the App. Superwall does not independently process payments.
8.8 Refunds
All payments are processed by Apple. Apple manages refunds for purchases made through In-App Purchase. Beast Labs does not have the ability to issue refunds directly.

Refund eligibility is determined by Apple in accordance with Apple's refund policies. Beast Labs has no control over Apple's refund decisions.
8.9 Price Changes
We may change subscription prices at any time. If you have an active auto-renewable subscription, you will be notified of any price changes in advance through the App Store. Price changes will take effect at the start of your next billing period following the notice. If you do not agree to the new price, you may cancel your subscription before the new price takes effect.
8.10 Partial Periods
If you cancel a subscription mid-period, no partial refund will be issued for the remaining time in the current billing cycle. You will continue to have access to Smart Nap Pro features until the end of the paid period.
8.11 Billing Grace Period
If your subscription renewal payment fails (e.g., due to an expired payment method), Apple may attempt to recover the payment during a limited grace period. During this grace period, you may continue to have access to Pro features. If payment is not successfully collected, your subscription will expire and Pro features will be deactivated. We encourage you to keep your payment information up to date in your Apple ID settings.
8.12 Switching Plans
You may switch between the Weekly and Yearly subscription plans at any time through your Apple ID subscription settings. If you upgrade from a lower-value plan to a higher-value plan, the change may take effect immediately with a prorated charge. If you downgrade, the change will take effect at the end of your current billing period. Plan changes are managed by Apple.
8.13 Post-Subscription Access
If your subscription expires or is canceled, access to all App features will be lost. An active Smart Nap Pro subscription is required to use the App. If you resubscribe, your access will be restored immediately.
9. HealthKit Integration
Smart Nap integrates with Apple HealthKit to read sleep analysis data. By granting HealthKit access, you acknowledge that:
- The App reads sleep data from HealthKit for the sole purpose of sleep onset detection and nap optimization
- HealthKit data is processed on-device only and never transmitted to external servers
- HealthKit data is never used for advertising, marketing, or shared with third parties
- You can revoke HealthKit access at any time in iOS Settings
The App does not write data to HealthKit. It only reads existing sleep analysis data.
10. Apple Watch Companion App
Smart Nap includes an Apple Watch companion app that provides nap tracking directly from your wrist. The Watch app:
- Syncs nap session data and preferences with the iPhone app via Apple Watch Connectivity
- Uses HealthKit on the Watch to detect sleep onset
- Delivers haptic and audio alarms on the Watch
- Operates as a self-care background mode app to continue monitoring during nap sessions
All data synchronization between iPhone and Apple Watch occurs over Apple's secure Watch Connectivity framework and does not pass through external servers.
11. Live Activities
Smart Nap may display Live Activities on your iPhone Lock Screen during active nap sessions. Live Activities show real-time nap status and are processed entirely on-device. They do not transmit data to any external service.
12. Notifications and Alarms
Smart Nap uses Apple's AlarmKit framework to schedule system-level alarms, as well as local notifications and audio, to deliver nap alarms. AlarmKit alarms are managed at the system level by iOS and require your explicit permission when first used. These alarms are created and triggered on your device. We do not use remote push notification services for alarm delivery. You can manage alarm and notification permissions in iOS Settings.
Important: Smart Nap relies on your device to deliver alarms. We cannot guarantee alarm delivery in all circumstances (e.g., device turned off, low battery, permissions revoked). You should not rely solely on Smart Nap alarms for time-critical situations.
13. Your Data
Nap sessions, preferences, and sleep timeline data ("User Data") are stored locally on your device. You retain ownership of your User Data. Our handling of data is described in the Privacy Policy: https://beast-labs.com/apps/smartnap/privacy-policy/
Data loss: Because data is stored locally, uninstalling the App or resetting your device will permanently delete all nap session history and preferences. We are not responsible for data loss resulting from device issues, App deletion, or operating system changes.
14. Intellectual Property
All content, features, and functionality of Smart Nap — including but not limited to text, graphics, logos, icons, images, audio clips (alarm tones), software, and design — are the exclusive property of BEAST LABS, SLU and are protected by international copyright, trademark, and other intellectual property laws.

15. Third-Party Acknowledgments
Apple is not responsible for Smart Nap or its content. Apple has no obligation to provide support, maintenance, warranty, or any other services related to Smart Nap. Any claims relating to Smart Nap, including product liability claims, must be directed to Beast Labs, not Apple.
The App uses the following third-party services, each governed by their own terms:
- RevenueCat — Terms of Service
- Superwall — Terms of Service
- Meta/Facebook SDK — Terms of Service
16. Service Availability and Changes
We may update the App, change features, add or remove functionality, or discontinue parts of the App at any time. We do not guarantee that any specific feature will remain available. We will use reasonable efforts to notify users of material changes.
17. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law. We do not guarantee:
- Uninterrupted or error-free operation
- Accuracy or reliability of sleep detection, sleep onset timing, or efficiency calculations
- That alarms will always trigger at the correct time or at all
- Compatibility with all devices, operating system versions, or configurations
- That HealthKit data will always be available or accurate
18. Limitation of Liability
To the maximum extent permitted by law, BEAST LABS, SLU is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of or inability to use the App, including but not limited to:
- Missed alarms, oversleeping, or being late due to alarm failure
- Inaccurate sleep data or efficiency metrics
- Any health-related issues arising from reliance on the App
- Loss of nap session data or preferences
- Service interruptions or subscription access issues
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or related to these Terms or the App shall not exceed the amount you paid to us (via Apple) for the App in the 12 months preceding the event giving rise to the claim, or fifty euros (EUR 50), whichever is greater.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
19. Indemnification
You agree to indemnify, defend, and hold harmless Beast Labs, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.
20. Termination
You may stop using the App at any time by deleting it from your device. Remember that deleting the App does not cancel any active subscriptions — you must cancel subscriptions separately (see Section 8.5).
We may suspend or terminate your access to the App if you violate these Terms, or if required for security, legal, or operational reasons. Upon termination, your license to use the App ceases immediately.

22. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use of the App after changes constitutes your acceptance of the updated Terms. If we make material changes, we will provide reasonable notice through the App or other means.
23. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Principality of Andorra, without prejudice to any mandatory consumer protection laws that may apply in your country of residence.
Any disputes arising from or related to these Terms or the App will be resolved in the competent courts of the Principality of Andorra, except where mandatory consumer protection laws require disputes to be resolved in the courts of your country of residence.
24. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
25. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from circumstances beyond reasonable control, including but not limited to: natural disasters, pandemics, government actions, power or internet failures, Apple App Store disruptions, or third-party service provider outages. During such events, affected obligations shall be suspended. If the event continues for more than 90 days, either party may terminate the subscription upon written notice.
26. Accessibility
We are committed to making Smart Nap accessible to all users, including those with disabilities. We strive to follow Apple's Accessibility guidelines and applicable accessibility laws. If you experience any accessibility barriers while using the App, please contact us at contact@beast-labs.com so we can assist you and work to improve accessibility.
27. Entire Agreement
These Terms, together with our Privacy Policy, Subscription Terms, and Apple's Standard EULA, constitute the entire agreement between you and Beast Labs regarding the App. These Terms supersede all prior agreements, representations, and understandings.
